What we handle here

Buying land or a house in the Dominican Republic is more than signing and paying: you need to know what the Registry of Titles says about that property, whether it has been surveyed and individualized, whether it carries mortgages or oppositions, and whether the seller is actually entitled to sell. We review the property before signing and carry the process through until the title is in your name.

Property purchase and sale

Drafting the sale agreement, verifying that the seller is the registered titleholder, calculating transfer taxes and following the file through to its filing at the Registry of Titles. A properly drafted contract is what separates a purchase from a ten-year lawsuit.

Title search and due diligence

Before putting down a deposit it pays to know what the property carries: mortgages, oppositions, pending litigation, seizures or heirs who have not been settled with. The legal status certificate is requested at the Registry of Titles and is the cheapest check available against the risk it prevents.

Title clearing and transfer

Title clearing (saneamiento) is the process by which unregistered land enters the system for the first time and a Certificate of Title is issued. Transfer is the next step in every sale: moving the title out of the seller’s name and into the buyer’s, which is the only thing that proves ownership against third parties.

Deslinde and cadastral survey

The deslinde is the process that locates and delimits your portion within a larger parcel so you can hold an individual title. It has a technical stage —the parcel survey carried out by a licensed surveyor and approved by the Regional Directorate of Cadastral Surveys— and a judicial stage before the Land Court. Estates and inheritance transfers

When the titleholder dies, the property does not transfer on its own: the heirs must be determined, the inheritance tax settled with the tax authority, and the documentation filed so the title can be transferred. It is the most postponed filing in the country, and the most expensive one to postpone.

Civil and property disputes

Litigation over registered rights, occupations, evictions, breach of contract and disputes between co-owners. Before filing suit we assess whether the case holds up with the documents that actually exist, because a lawsuit started without a basis costs more than negotiating it well.

What is a deslinde and why am I being asked for one?

It is the process that individualizes your portion within a larger parcel. Without it there is no Certificate of Title of your own, and without your own title the property is hard to sell, hard to mortgage and hard to inherit without conflict.

How do I know whether land has problems before buying it?

With a legal status certificate from the Registry of Titles, which shows the recorded charges and encumbrances. It is a step that comes before any money changes hands, not after.

Do you carry out the survey, or only the legal side?

The technical work —parcel survey, cadastral measurement and plans— is carried out by our partner firm Agrimensura.com.do. We handle the title, the contracts and the representation before the Land Court, and between the two offices the full process is covered.
